TERMS AND CONDITIONS Use of our website, www.opendoorclinic.org (the “Site”) is provided by Open Door Clinic of Greater Elgin (“Open Door”) and is subject to the following “Terms and Conditions”:

  1. ACCEPTANCE OF TERMS

    Your use of our Site constitutes your acceptance of the Terms and Conditions. If you do not accept the Terms and Conditions in full, you must stop using our Site immediately.Open Door may change the Terms and Conditions at any time by posting updated Terms and Conditions to our Site. Your continued use of our Site after changes are posted constitutes your acceptance of the Terms and Conditions as modified.You may use our Site only for lawful purposes, and in a manner which does not infringe the rights of, or restrict or inhibit the use and enjoyment of our Site by, any third party. 

  2. INTELLECTUAL PROPERTY; LIMITED LICENSE TO USERS

    Our Site and the information, names, images, pictures, and logos regarding or relating to Open Door are provided “as is,” without any representation or endorsement made by Open Door or any third party, and without warranty of any kind whether express or implied. You acknowledge that such information and materials may contain inaccuracies and/or errors.  In no event will Open Door be liable for any damages whatsoever, including, without limitation, indirect or consequential damages arising from use of our Site or in connection with use or loss of use of our Site, whether in contract or in negligence, save that this condition will not restrict our liability for any kind of loss which is not permitted to be limited by law.

    Open Door does its best to ensure that our Site is functioning correctly and that materials contained on our Site are timely and accurate. However, Open Door does not warrant or represent: (a) that the functions and materials contained on our Site will always be uninterrupted or error free; (b) that defects will be corrected; (c) that our Site, and the server that makes it available, are free of viruses or bugs; and (d) the full functionality, accuracy and reliability of the materials found on our Site.

    We invite you to bring to our attention concerns that you may have about the accuracy of our information.  Please feel free to notify us of a potential inaccuracy by sending a copy of the subject material, along with your comments regarding the inaccuracy, by email to media@opendoorclinic.org.

    Photographs: the inclusion of persons in images or photographs on our Site should not be construed as indicating their health status. Individuals who are mentioned or whose photographs appear on our Site are not necessarily HIV positive or have AIDS. In order to respect the privacy of the children and adults with whom we work, the photographs and names used on our Site are not necessarily those of the actual people concerned.

    Any communication or material that you transmit to, or post on, any public area of our Site including any data, questions, comments, suggestions, or the like (a “Contribution”) is, and will be treated as, non-confidential and non-proprietary information. On posting any Contribution to our Site, you confirm that you are granting Open Door a perpetual (and irrevocable), royalty-free, worldwide, non-exclusive license to use your Contribution for any purpose in any media in any part of the world. This includes the right for Open Door to copy, edit, publish, grant sub-licenses to, and exercise all other copyright and publicity rights over the Contribution. You also waive all “moral rights” to the Contribution (as “moral rights” are defined in the Copyright, Designs and Patents Act 1988).  If you do not wish to grant us these rights, please do not post a Contribution to our Site.

You may not interfere with anyone’s use or enjoyment of our Site.     If there is any conflict between these Terms and Conditions and any rules and/or specific terms of use appearing elsewhere on our Site, these Terms and Conditions shall prevail.

  4. DISCLAIMER

    Our Site contains HIV prevention messages that may not be appropriate for all audiences. If you are not seeking such information or may be offended by such materials, please leave our Site immediately. Since HIV infection is spread primarily through sexual practices and by sharing needles, prevention messages and programs may address these topics. While HIV prevention materials funded by the Centers for Disease Control and Prevention must be approved by local program review panels, these materials may still be considered controversial by some viewers.

    Our Site is not designed to provide medical care. If you are ill, please seek medical advice from a licensed practitioner.

    Open Door takes no responsibility for the content of external websites. In addition, links to these websites cannot be taken as any endorsement of the content of the websites, or approval by Open Door of the views and expressions on these websites.

  5. LIMITATIONS

    Where information or material has been posted by a third party on our Site, including the Open Door blog or an Open Door social networking profile, including Facebook, Twitter, LinkedIn, You Tube and Flickr, Open Door takes no responsibility for the contents of the posting.  The posting may not have been reviewed by Open Door.  Please do not post inappropriate, confidential or sensitive information or materials for which appropriate dissemination rights have not been obtained.  We invite you to bring to our attention any information or material you believe to be inappropriate, confidential, sensitive, or unlawfully disseminated.

  6. LINKS TO THIRD PARTY SITES

    External links to Open Door: any organization wishing to set up a link to this Site must make a link request via email at media@opendoorclinic.org.

  10. GOVERNING LAW AND JURISDICTION

    These Terms and Conditions are governed by and shall be construed in accordance with the laws of the State of Illinois. You hereby consent to the personal jurisdiction of the state and federal courts located within such state. All actions, controversies and disputes arising from or relating to these Terms and Conditions shall be heard and decided exclusively before the appropriate state or federal court located in the City of Chicago, Illinois. The invalidity or unenforceability of any part of these Terms and Conditions shall not affect the validity or enforceability of the balance hereof.
